GENERAL TERMS AND CONDITIONS

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before submitting a request for quotation or placing an order with our company. By sending a request or order, you agree to be bound by these Terms and Conditions, which govern the commercial relationship between you and GIFTS SERVICE SRL (hereinafter referred to as the “Supplier”).

2. Custom-Made Products and Order Process
All our products are custom-made according to each client’s specifications. We do not hold stock; each order follows a unique production process.
Steps in the ordering process:
- Request for quotation via email or contact form
- Submission of vector artwork (preferably .cdr format) and Pantone colors
- Confirmation of order and quotation acceptance
- Delivery of visual mock-up for approval
- Issuance of advance invoice (50%)
- Production starts only after artwork approval and receipt of payment
- Whenever possible, a photo of the final product will be sent prior to shipment
- In some cases, a sample is produced and approved before full production begins
3. Binding Orders and Legal Responsibility
By placing an order, the Client confirms that they hold all legal rights for the submitted artwork and understands that once production begins, the order cannot be modified or canceled.
A technical tolerance of ±10% is accepted for quantity, size, color, or other product parameters.
4. Payment
- The advance invoice (50%) is issued after order confirmation
- The final invoice (remaining 50%) is issued upon completion of production and must be paid before delivery
- Whenever possible, a photo of the finished product will be provided
- In certain cases, a discount may be granted for full advance payment, evaluated individually
5. Delivery Terms
Standard production and delivery time: approx. 30 days, starting from the day we receive:
- the confirmed order
- the final approved artwork
- the advance payment
This period can be shortened or extended based on prior agreement, holidays (e.g. Christmas, Easter, Chinese New Year), or other external factors. These will be communicated at the time of ordering.
The Supplier is not responsible for delays caused by customs, couriers, or national holidays.
We strongly recommend ordering in advance to avoid last-minute issues or dissatisfaction.
Shipping is carried out by express courier to the address provided by the Client. Delivery methods and any extra costs will be specified in the offer or via email.
For urgent orders, an express fee may apply, depending on the case. Please contact us to discuss the possibilities.
6. Right of Withdrawal and Returns
Our products are made to order and always based on the Client’s specifications (artwork, color, size, quantity, etc.). Therefore, the consumer’s right of withdrawal is not applicable.
Legal basis:
- Romania: Article 16(c) of Government Ordinance no. 34/2014 excludes the right of withdrawal for “products made according to consumer specifications or clearly personalized”.
- Hungary: Section 29 (1)(c) of Government Decree 45/2014 (II.26.) excludes the right of withdrawal for “non-prefabricated products made based on consumer instructions or requests, or clearly personalized”.
- European Union: Article 16(c) of Directive 2011/83/EU of the European Parliament and Council (Oct 25, 2011) states that the right of withdrawal does not apply to “goods made to the consumer’s specifications or clearly personalized”.
Therefore, we do not accept returns of custom-made products unless a manufacturing defect or non-conformity with agreed specifications can be clearly proven.
In such cases, the Client must notify us in writing within 48 hours of receiving the goods. We will assess the issue and propose a suitable solution (reproduction, correction, partial refund, etc.).
7. Data Protection
GIFTS SERVICE SRL complies with all regulations regarding the protection of personal data, including Regulation (EU) 2016/679 (GDPR). Client data is collected and processed exclusively for the purpose of fulfilling orders, communication, invoicing, and delivery.
We do not share your personal data with third parties without your explicit consent, except where required by law or for delivery purposes.

8. Limitation of Liability
To the fullest extent permitted by law, GIFTS SERVICE SRL shall not be liable for indirect or incidental damages, minor aesthetic deviations, or delivery delays, provided these do not affect the intended use of the product. Our total liability is limited to the value of the placed order.
8.1 Force Majeure
The Supplier is not liable for delays or failure to perform obligations due to force majeure events (natural disasters, strikes, pandemics, armed conflicts, etc.).
Client advisory: To avoid unforeseen delays, we recommend placing your order well in advance of your planned event or deadline.
9. Governing Law and Dispute Resolution
These Terms and Conditions are governed by Romanian law. Any dispute will first be attempted to be resolved amicably. If this is not possible, the competent courts in Romania shall have exclusive jurisdiction.
10. Final Provisions
These Terms constitute the entire agreement between the parties and supersede any prior arrangements. We reserve the right to update these Terms at any time. The updated version will be published on our website.
